Civic access Art. 5 of Legislative Decree 33/2013
Legislative Decree no. 33 of 14/03/2013 introduced, together with the obligations of publicity, transparency, and dissemination of information by Public Administrations and equivalent bodies, the concept of “simple” civic access, to which “generalized” civic access was added with Legislative Decree 97/2016. Access to administrative documents and information or data may occur in the following cases:

Document access request: it is the power/right of interested parties to request, view, and potentially obtain a copy of administrative documents pursuant to Art. 22 of Law 241/1990. The right of access to administrative documents is recognized to anyone with a direct, concrete, and current interest in the protection of legally relevant situations.

Simple civic access request: it is the right of anyone to request documents, information, and data that the Bodies are obliged to publish, pursuant to Art. 5, paragraph 1, of Legislative Decree 33/2013, in the event that they have failed to make them available in the “Transparent administration” section of the institutional website.

Generalized civic access request: it is the right of anyone to request documents and data of the Bodies, pursuant to Art. 5, paragraph 1, of Legislative Decree 33/2013, as modified by Legislative Decree 97/2016, in addition to those subject to mandatory publication. The request for simple and generalized civic access must be submitted via email to the certified email address (PEC): amministrazione@pec.villasantachiara.it
